E-2/E-1 Employee?

By e2advisor - Posted on 12 July 2010

You can apply for an E-2/E-1 visa as an employee of a successful company in your home country, which wishes to expand its market or operation into the United States. In this case, you might also consider applying for L-1 if you do not qualify as an E-2/E-1 employee: if a company is a large company, it might qualify for "blanket L-1" visas. In addition, even H-1B might be an option, although the company probably will not want to apply for H-1B for its employees for various reasons.

Not all types of employees can obtain one of the above types of visas. The employee has to be executive, manager, supervisor or an "essential" employee, and has to possess the same nationality as the E-2/E-1 enterprise company in the United States.

This section will cover various issues that arise in context of an employee attempting to enter the United States to work at the affiliated company.
